Terms of Service

These Terms of Service ("Terms") govern your use of OurCampusBD("the Service", "the Platform"), a school management software operated by OurCampusBD in Bangladesh. By subscribing to or using the Platform, you agree to these Terms.

1. Eligibility

The Platform is intended for use by registered educational institutions in Bangladesh, including schools, madrasahs, colleges, and coaching centres. You must be authorized to bind your institution to these Terms.

2. Account & Tenant Provisioning

  • Each institution is provisioned as a separate "tenant" with its own subdomain at <your-school>.ourcampusbd.com
  • You are responsible for keeping admin credentials secure and for all activity under your tenant
  • You must provide accurate school information (name, address, phone, email) at signup
  • Sharing admin credentials with unauthorized parties is prohibited

3. Acceptable Use

You agree NOT to:

  • Upload illegal, defamatory, obscene, or copyright-infringing content
  • Attempt to reverse-engineer or probe the Platform's security
  • Use the SMS feature for spam or unsolicited marketing
  • Enrol fake students or manipulate attendance / exam data for fraudulent purposes
  • Resell, sublicense, or white-label the Platform without a written agreement
  • Use the Platform in any way that violates Bangladesh law including the Digital Security Act 2018

4. Subscription & Billing

  • Subscriptions may be billed monthly or yearly
  • Payments are accepted via bKash, Nagad, Rocket, ShurjoPay, or bank transfer
  • Fees are due in advance. Non-payment results in account suspension after a grace period
  • All pricing is in Bangladeshi Taka (BDT) unless stated otherwise
  • See our Refund Policy — all fees are non-refundable except in narrowly-defined exceptions

5. Data Ownership

You own your school's data — student records, attendance, results, financial transactions, photographs. We merely store and process it on your behalf. You can export your data in CSV/JSON format at any time.

OurCampusBD owns the Platform itself — the source code, design, algorithms, and trademarks.

6. SMS Notifications

  • SMS credits are purchased separately from your subscription
  • The school is responsible for the content of messages sent through the Platform
  • We route SMS via BulkSMSBD and bear no liability for gateway downtime, delivery failures, or content moderation by the gateway
  • SMS credits, once added to your balance, are non-refundable (see Refund Policy)

7. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance is communicated in advance. Unplanned downtime due to third-party failures (payment gateways, SMS providers, cloud infrastructure, national internet disruptions) is outside our control and does not entitle you to compensation.

8. Modifications to the Service

We may add, change, or remove features at any time to improve the Platform. We will provide reasonable notice for material changes that remove functionality you actively use.

9. Termination

Either party may terminate with written notice. We may suspend or terminate your account immediately if you:

  • Fail to pay invoices after a 30-day grace period
  • Violate these Terms, particularly the Acceptable Use clause
  • Initiate a chargeback without prior communication with us
  • Engage in activity that endangers the platform or other tenants

10. Limitation of Liability

To the maximum extent permitted by Bangladesh law, OurCampusBD's total aggregate liability to you for any and all claims arising out of or relating to the Platform shall not exceed the total amount you paid to us in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data loss due to your own actions, reputational harm, or loss of business opportunities.

11. Indemnification

You agree to indemnify and hold OurCampusBD harmless from any claim arising out of content you upload, messages you send, or your misuse of the Platform.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute shall be subject to the exclusive jurisdiction of the competent courts in Dhaka, Bangladesh.

13. Changes to These Terms

We may update these Terms. Material changes will be communicated via email to your registered administrator at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
